Author Topic: Chargeback for cash withdrawals abroad?  (Read 349 times)

Hypothetical scenario.

Let’s say someone is on holiday in the Dominican Republic and matches with someone on Tinder. They agree to meet, and it ends up being two girls. The agreement is 100 usd each, plus 20 usd for the room.

It’s late at night and the person doesn’t have cash, so the girls suggest going to an ATM. At the machine, the PIN is entered incorrectly once. After that, they withdraw 15k dop then another 15k dop and then an additional 5k dop. It also took the person a bit of time to work out the conversion rate, so at the moment of withdrawal they didn’t fully realise how much was actually being taken in USD terms. They took out roughly 600usd/450gbp.

The service was provided as agreed.

In a situation like this, would it be a bad idea to try a chargeback with the bank, claiming coercion or something along those lines? What are the realistic chances of the bank freezing or closing the account over something like this?

Asking for a friend.

First off that does not sound like a chargeback. You cannot chargeback cash withdrawals.

Pretty sure it won’t work. It was not a robbery and refunding money from an ATM robbery would need to be reported immediately and with a crime reference. Not sure how you get one if abroad if they even have one or if a UK bank can use it.

I believe banks have been known to refund some people who have been robbed at knifepoint at ATMs but it is at their discretion. I don’t think they would close the account but may just refuse the refund.

It sounds like it was a case of drunken stupidity with the owner of the account not knowing the currency conversion rate and letting the SPs withdraw more than the agreed amount.

Charge backs aren't relevant to stupidity.

Chalk it up to experience and don't do it again.

or you try explaining this to your bank "I was in the Dominican Republic on holiday. I had been drinking and these two local hookers approached me and I agreed to shag them for a fee. I didn't have the cash on me, so I freely took them to an ATM where I freely entered my PIN and let them withdraw cash from my bank account. We then went and had sex as per the agreement. I later realised that they had taken more money than I had expected them to take. I would like the bank to refund me the money that I freely allowed them to take from my bank account via the ATM.  When can I get the money back?"

Bank says: "Let me just check I'm understanding this correctly. You agreed to shag two hookers fir money. You freely gave them access to you bank account and let them withdraw cash from it. They shagged you as agreed and then you realised you had overpaid them and you would like the bank to refund you the overpayment you made? Is that correct, sir?"

Be prepared for them laughing a lot and then say "Pull the other one, it's got bells on.. You plonker. We are not refunding the money. We suggest that you surrender your bank cards to a nominated competent adult and don't do this again".
