under employment law, an employer is responsible for ensuring a safe and harassment free etc envoronment. So someone "not directly related" to something can still feel offended - for example if two work colleagues are talking between themselves but in an open environment and using bad or offensive language (including racist) then they have a legitimate complaint and the employer has a legal duty / responsiblilty to take appropriate action. The fact that the person concerned has said that they were not offended by the comment shows that it was made!

although this wasn't a direct employer/emplyeee situation the same principles apply - and as i understand it, the BBC hasn't sacked him but rather chosen not to renew his contract. Two different things.

Many years ago, I had to do some mandatory diversity training, and an example given was one of  police officers who participated in a secret Santa within their team - one of them bought a Muslim colleague a bottle of alcoholic drink. The recipient found it genuinely funny, unfortunately, an onlooker didn't and reported it - instant disciplinary, and, after due process, dismissal.

I'm no Lawyer, but surely if they were having a meeting regarding work, it automatically becomes as "work setting"?
Either way, I. guess that's why they went down the line of not renewing, rather than dismissal. Presumably, if they don't commission another series of Masterchef the job he was contracted for no longer exists.

I don't know much about the show, preferring Alton Brown's style who would make a good presenter for Master Chef.

I think we can all agree they the BBC has a lot of serious issues about many things. However, most of their content (except the News) is made by Independent production company's so their ability to monitor on set behaviour is rather limited, and in Wallace's case seems to have taken place in what could be considered a non work environment.
This is not to say that I condone bad behaviour in any way, but why aren't the production Company's also being vilified for their apparent inaction?
