Oh dear this is going to get like the "Are Jaffa cakes actually cakes or biscuits"

My natural instinct is to say they are cakes but if they aren't cakes then what classification are they 
I remember watching an episode of QI where this was raised. There was some court case with McVitie’s to determine the tax bracket of Jaffa Cakes (I kid you not) as cakes and biscuits essentially have the same ingredients but are taxed differently, a cake being deemed as a staple food item thus exempt from VAT whilst a biscuit is a luxury item so VAT is payable. The government argued as Jaffa cakes were usually stocked with other biscuit that it’s a biscuit.
If my memory is right then the ‘experts’ conclusion, after baking a giant Jaffa cake (still not kidding) was that if the product goes hard when it goes stale then it’s a cake and if it goes soft then it’s a biscuit. A Jaffa cake apparently goes hard so it’s a cake!
Fun fact, the chocolate side of a Jaffa cake is apparently the bottom side
