I have the same issue, there's a few links to "view desktop site" when browsing on mobile, during login and in the footer if I recall. Alternatively, your mobile browser might have a "show desktop version" option.

That's the key there I think, in practice they may or may not disclose acccording to the individual but if they're sued for it then they'll probably get convicted for GBH or somesuch
