Can we get back to us adults and Scots Law? Note - it's Scots Law and not Scottish Law.
I'm no expert so opinions, please - or, just, help. As I see it a main requirement in Scots Criminal Law is 'corroboration' and 'strict liability' doesn't allow for corroboration. The SNP stand accused of trying to sneak things through that will dilute the strengths of Scots law - the Hate Crime and Public Order (Scotland) Bill being but a recent example - another has been the call for strict liability in football, where clubs would be held responsible for the behaviour of their supporters. I'm sure that all Glasgow punters will be aware of these two examples?
Whether there are valid examples, of strict liability, being in any piece of Scots Law, I don't know but in Criminal Law, it seems unlikely.
I should add that, much as the SNP are trying to dodge proper scrutiny, in Scotland; the Tories are doing the same in England - especially during the pandemic, so I've no political axe to grind.
