I was down in Cardiff earlier on. I have no idea were the red light area is there but I obviously found myself in it because I found myself passing an enormous pair of tits in a black top and red jacket and she was waving at me lol. Section 19 of the Policing and Crime Act 2009 introduces section 51A into the Sexual Offences Act 2003 and creates a new offence for a person in a street or public place to solicit another for the purpose of obtaining a sexual service as a prostitute. The reference to a person in a street or public place includes a person in a motor vehicle in a street or public place.

This replaces the offences of kerb crawling and persistent soliciting under sections 1 and 2 of the Sexual Offences Act 1985 with effect from 1 April 2010.

A person guilty of an offence under this section is liable on summary conviction to a fine not exceeding level 3 on the standard scale.

Charging Practice

The effect of this amendment is to remove the requirement to prove persistence. This will enable the charge and prosecution of an offender on the first occasion they are found to be soliciting without the need to prove persistent behaviour, or that the behaviour is likely to cause annoyance or nuisance to others.

Although a matter for individual CPS Areas, sometimes an approach may be adopted with the police designed to respond to local circumstances and the local prevalence of kerb crawling. For example, high visibility policing in red light areas, with posters advertising that kerb crawlers will be prosecuted and disqualified and with signs in these areas detailing how many kerb crawlers had been arrested and prosecuted. Some police forces carry out regular surveillance operations in known red light areas, with a zero tolerance strategy adopted. All those arrested are bailed to the same court date, dealt with by the same bench and the local press are encouraged to report it.

On conviction in appropriate cases, the prosecutor should consider drawing the court's attention to any relevant statutory provisions relating to ancillary orders for kerb crawling such as their powers to disqualify from driving under section 146 of the Powers of Criminal Courts (Sentencing) Act 2000 or to deprive an offender of property, used to commit or facilitate the offence under section 143 Powers of Criminal Courts (Sentencing) Act 2000. A year ago I was dropping my kid off and pulled into a layby to turn round. Some old codger was waiting there - he approached my car and opened the door before getting a truckload of abuse. I guess he was waiting for a taxi or something and I would have been less jumpy if I didn't have my kid.

I used to have to drive through the area on my way to and from work and on at least two occasions the police were running checks on cars and if you were a male, alone in the car, you would be pulled over and asked what you were doing there.

It is a bit of a grey area but I would assume the police would have seen you talk to more than one known pro$$ie before they decide to take action, your number could already be on their watch list from CCTV records.

I haven't punted on the streets for years now and have no intention of any more. I used to enjoy visiting a number of RLDs but the combination of CCTV and ANPR cameras mean it is way too risky.

You can think of all the excuses under the sun for just passing through, got lost etc etc etc and sure the police will probably only prosecute if they have a record of multiple visits by a given punter but it doesn't stop them giving you a very hard time. The zero tolerance approach from time to time in RLD's local to me mean letters home. Mrs CBP  wouldn't be amused  :scare:

I used to live in Bradford & after losing nearly all my cash apart from £10 which i was saving for some marlboro's i chose to walk home via Thornton Rd instead of getting a taxi. I would never see a street prostitute not only illegal but there usually on serious hard drugs and usually look a mess, feels very dirty to me. If there out walking the streets at all hours and in freezing cold weather and off there face it shows how desperate they are and i just think of how many STD's there riddled with.
