Hi All,

This is a question for all the legal eagles amongst us.

My understanding of the law is that if two or more girls are operating from the same premises then the premises is considered a brothel which is illegal.  Now, during a punt a couple of months ago, I thought I was alone in the flat with my girl of choice, but it became apparent mid punt that there were at least two other people in the flat.  So my question is in the event of a raid, would I have been carted off by the boys in blue, or would it be the girls, or everyone in the flat for that matter? 
I'm sorry if this seems like a lame question, but I would appreciate it if someone could clarify the legalities of such a situation.

It is not illegal to visit a brothel unless it can be proven that the girls working there are doing so against their will, I have never read of a successful prosecution, if anyone else has then could you provide a link.

Trafficking may well happen but not on the levels the media would have us believe.

A premises is a brothel even if only 1 WG works from it BUT on another day another WG works from the same place.

Its the brothel owner and any staff that actively help run it like the receptionist/maid who could get done, the WGs and the punters arent breaking the law unless its proved a WG or more was being Coerced or was Underage. Note, to the letter of the law punting with a Coerced WG is a strict liability offence, that means you are presumed guilty having to prove you werent aware she was being Coerced which is impossible as punters wouldnt know unless the WG said she was to them. However, not one prosecution has been found for this offence that i know of or have read. It was more designed to scare punters off punting than prosecuting them it seems.

If caught up in a raid which is unlikely, not happened to me in 30 years of punting my advice is give your real name but nothing more saying you want to speak to your Solicitor. Its likely the police will just make a note of your name and tell you to leave. Giving a false name could get you into police bother.

Anth and Smiths are bang on - you and the WG haven't committed any crime, and I don't think it's the brothel which is illegal - it's 'controlling' prostitutes or 'keeping' a brothel which is an offence. So as Smiths points out the owner and even the Maid can get done.

But this is English law so you wouldn't expect anything like common sense or logic to apply - so you can of course have a brothel without any prostitutes in it!

Kid you not, the CPA briefing says 'A brothel is defined as "a place where people of opposite sexes are allowed to resort for illicit intercourse, whether the women are common prostitutes or not". It is not essential to show that the premises are in fact used for the purposes of prostitution (which involves payment for services rendered); a brothel exists where women offer sexual intercourse without charging.'

So if you let your teenage kids have a party at your house chances are they have turned it into a brothel. It's more about not upsetting the neighbours, so this covers wife swapping clubs, swingers parties and no doubt every student halls of residence. And because this discriminated against gays who weren't included, they changed the law specially so they were barred from having fun in bath houses and saunas too.

I would say these laws are medieval but they were only passed 40 odd years ago - our laws in the Middle Ages made more sense because they licensed brothels and it was the Church of England that controlled most of them - they won both ways, got paid for the original sin then sold you a 'pardon' for it to avoid hell!

Of course I am totally immune from ever running a brothel because it doesn't matter how many women there are in my house I am never in any danger of ever being offered sex.

Wow, there's certainly more to this than I realised, thanks Barry & Smiths.  I may even visit the agency in question again now I'm not feeling quite so paranoid, if they ever get their management sorted out & stop mistreating their girls.

Sound advice from James - re- read the piece from Smiths which highlights any coercion is a potential crime regardless of how many are in the flat.

Didn't realise which agency this was - I assume it was 'old' North Angels, wouldn't be surprised if the others in their included their 'bouncer'. The owner has said he won't allow any flat sharing or mistreatment in other threads on here.

I hope so - few years back I was in an Escorts North East flat which was like the Toon on a Saturday night, three girls in a two bedroom flat and I shared the lift with a fourth one who followed me in. Police in the North East won't stand for that behaviour now so they've all changed the way they operate, I hope he has too. See even Anth's tempted by their £70 punt deal!

While that may be true it would be very hard to achieve a successful prosecution ----------- I have not read about a single case of a punter being taken to court.    :hi:

Got the Agency in one Barry, as I've said in a different thread though, if I had known about their past operating practices at the time, I wouldn't have booked.  As good as the punt was (with Ruby), I'd prefer to avoid any agency that operated in that manner.  The £70 offer is quite tempting though:)
