I had a punt in brum a few weekends back so used the bpa car park. Paid for an hour and had th ticket on display.

Just had a letter come through wanting me to pay a fine as I didn't pay to park there (when I did pay)

I'm going to try to dispute it but as I chucked the ticket and paid by cash it's going to be difficult to prove.

Thought I'd better warn fellow punters as there are quite a few girls within walking distance of there.

Tosspots. But, the important thing: it's not a fine, as they have no right in law to fine you. It's essentially a notification that, according to them, you've broken a term of their contract. I would, very politely, tell them to fuck right off. The only thing they can do then is take you to court.

That's OK unless you have to explain to your misses why you were parked there.
Always a worry with parking.

I nearly got caught at The Quality Hotel in Wolves because I hadn't checked the car in at reception.
Luckily the prossie bailed me out and told them it was her partner visiting.

So be warned if you use that hotel.

Or your boss, if you have a company car, especially if you were not supposed to be anywhere in the viscinity of that car park!!  :scare:

Case law has changed recently, whilst it is an invoice, they can claim they suffered a loss, this was a decision hy the court of appeal which overturned two lower courts decisions telling the company to fuck off!

One way to dispute is ask fof video evidence of the car park and ticket machines, most of these places are surveiled and presumably you couldnt get out without a paid ticket!??

All moot of course if you want to keep it quiete fron the missus?

It's just one of those crap gravel car parks but they have (hidden) cameras that photo your number plate when you enter and leave (which came through on the paperwork they sent through).

I'm particularly irritated as I parked there on the 4th June, they printed the letter on the 10th and it arrived this morning. I only chucked the ticket Thursday / Friday last week.

It smells like a scam the people who run the car park are running. Without that damn ticket I can't prove that I paid, but equally they can't prove that I didn't.

I used the appeal process on their website to dispute it so we will see what they come back with.

I would have no objection to paying it if I had actually tried to stiff them but I had genuinely put enough cash in the machine to cover my stay - grrr!

If you are up for the fight, (i.e. not hiding from the mrs), they will have to provide some evidence.  Was it a pay & display, if you were displaying they couldn't produce photographic evidence that you weren't.

Good point, council officials have to photograph the car to prove no ticket was displayed, even though it was a private car park it should be reasonable to ask them to produce photographic evidence, no evidence = weak case...

Actually, I'm not being terribly clear.  The burden of proof that you didn't pay is entirely on them.  It is not on you to prove that you did. 

If you did, you did.  It is not unreasonable that, a week later, you would not still have the ticket in your posession.

Ignore it, I allways do. You will get a couple of reminders, then a heavy letter from an associated company calling themselves debt collectors then they give up.
If it ever went to court they would have to prove loss which would only be for an hours parking and that's what you'd have to pay. That's why they never take anyone to court.
Just google bpa and read all about it.

Exactly this! These private car park 'fines' are best ignored.
It is never worth their while taking it to court. They will send letters threatening court action but just rip them up and you will hear no more.

Just a little help for you BOD has ive worked in this sort of field before and i asked a friend today for you who still works in this area of work if you are Perfectly happy to recieve 2 - 3 more letters from the company over the next 1 - 2 months then do has follows when you receive your second  letter send a letter or email back stating you entered the car park at the time you did   paid at the machine and time you  left the car park Also putting at the bottom you have spoken to a legal team has you believe you feel this is a scam and they have first instructed you that if i receive any more i shall go to the local council

This will proberly get a letter sent out saying due to the situation we will half the cost of the fine if you pay within 7 days (do not )

simply send another letter or email saying  you will contact the council  this will proberly nnow put the situation to bed and they will send a letter saying good will gesture they will cancel the fine

This will show its another hardcore waste land car park to avoid i know of 8 around birmingham

Now if they are above board  and they do not have a camera somewhere in the carpark filming on the carpark machine so they cant  prove you have paid or not then ask for proof of a picture of you car parked with no ticket on your dashboard or stuck to the car window ( now there is a clause in the window they have the right that the ticket and it does say must be displayed on the drivers window or dash board or drivers side of the front windscreen putting the ticket on the passage side window can still get you fined even if you paid )
If they can not come up with any pictures of your car with no ticket in or you walking from your car and avoiding the machine they really have no proof and the court will not accept this the court can ask the car park company to audit there machine has for example  say on the day you parked only 10 cars came in that means the car park machine would have printed 10 tickets

The last thing iam not to sure on the car park you went to but you say it got a picture of your car number plate was in a barrier car park which lets you in then you go to the machine pay your money say 1 hour then on return go through a barrier to exit there are some places where you have to enter your ticket back in the barrier has you exit if you dont know this and tail gate some one out the car park because the barrier is still up it then the barrier computer which records the number plates come in and out  still thinks you have not   paid because its not received your card so in which case again  an be sorted by the ticket machine taken more more then what has been processed

the ones to watch out for are the ones in supermarkets

Lol i wouldn't worry in slightest about a private car parking fine

Ignore/burn/shred the letter, ignore all future comms and watch how literally nothing happens as a result

Thanks for the detailed post vision. I disputed the fine via their website and haven't heard anything from them since...

It was the big gravel car park at the end of Bromsgrove street. I think it is a scam they try to see how many people just pay.

I'm going to take the advice on here and ignore it now (& never use that car park ever again!)

When I went to see sexy tori I parked in the gravel car park with the fox mural on the wall. I've kept that ticket just in case ;)

+1, they would have to provide a windscreen shot plus move back and take a picture of the front of your vehicle including your plates and windscreen. P.s for future reference take a picture of your ticket and upload it to google box/ drop box or icloud, if the other half asks say it work related proof so you get refunded
