It does put the Goverment in a no win situation - the Law says they're men, so go to a men's prison. If they do and s/he gets raped, they're in the shit, put them in a women's prison and s/he rapes someone, they're in the shit.

Factually a man having sex with a biological man is a homosexual sex act but it doesn't necessarily make you homosexual I guess.
