Just to make the law clear, here is the official information which makes it clear that it has to be "without their knowledge".
"Upskirting is a highly intrusive practice, which typically involves someone taking a picture under another person’s clothing without their knowledge, with the intention of viewing their genitals or buttocks (with or without underwear)".
They can only they give permission if they know.

You responded to the whole post it's only now you are highlighting the part you meant to question.

Edit, not sure what this means "They can only they give permission if they know." but unless you ask them if you can take the photo and they say yes then it's illegal. Even if they never find out it's been done a crime has still been committed.
