Technically it could be soliciting if he was in a street or other public place (even if he was in a vehicle) when he solicited for sexual services even if it was by phone or internet - s.51A SOA 2003.

CPS wouldn't run with it though, not for a level 3 summary offence. That's not to say that if he was stupid enough to admit it, the police wouldn't offer him a caution.
